Terms of Service

Who can use Bailey's Tulips

You must be at least 18 years old (or the age of majority where you live) to create an account, make a purchase, or create a gift. By using the Service you represent that you meet this requirement and that the information you provide is accurate. The free daily puzzles are intended for a general audience but the Service as a whole is not directed to children.

What we provide

• 🌷Daily puzzles: a set of free puzzle games refreshed each day, playable without an account.
• 🌷Gifts: a flow that helps you turn a personal story into a set of custom puzzles a recipient solves to unlock your message, photo, and a celebratory reveal.
• 🌷Optional accounts: sign-in to save streaks and statistics across devices.

We may add, change, or remove features, and some features depend on third-party services being configured. We aim for reliability but provide the Service "as is" (see Disclaimers).

Accounts

If you create an account, you're responsible for the activity under it and for keeping access to your email secure (sign-in uses a link sent to your email). Tell us promptly at [email protected] if you suspect unauthorized use. We may suspend or terminate accounts that violate these Terms.

Purchases, pricing & refunds

• 🌷Creating a gift is a one-time purchase at the price shown at checkout (currently a single flat price for the full set of puzzles). Prices may change, but changes won't affect a purchase you've already completed.
• 🌷Payments are processed by Stripe. By purchasing, you also agree to Stripe's terms. We don't store your full card details.
• 🌷Because a gift is a personalized digital product that's generated for you immediately, all sales are generally final. If something went wrong — a failed delivery, a defect, or a charge you don't recognize — contact [email protected] and we'll make it right, including a refund where appropriate. Nothing here limits refund rights you have under applicable consumer law.
• 🌷When no payment provider is configured (for example, a demo deployment), gifts may be created without a charge. Don't rely on demo mode for anything you need to keep private or permanent.

Your content & the rights you give us

"Your Content" means everything you provide to build a gift: names, your message, the reveal text, puzzle answers/clues, recipient contact details, and any photo you upload. You keep ownership of Your Content.

You grant us a limited, worldwide, royalty-free license to host, store, process, transmit, and display Your Content solely to operate the Service — that is, to generate the puzzles, deliver the gift, and show the reveal to the recipient. This license ends when the content is deleted, except for backups kept for a short period and anything we must retain by law.

Your promises about Your Content

• 🌷You have the right to provide it, including the right to share any recipient's name, email, or phone number with us to deliver a gift to them.
• 🌷If a photo or message includes another person (including a child), you have the necessary permission, or are their parent/guardian, to include it.
• 🌷Your Content doesn't infringe anyone's rights or break the law, and isn't covered by Prohibited uses.
• 🌷You're responsible for the accuracy of recipient contact details — we deliver to what you give us.

Acceptable use

Don't use the Service to create, upload, or send anything that:

• 🌷is unlawful, harassing, threatening, hateful, defamatory, or invades someone's privacy;
• 🌷is sexually explicit, or sexualizes or endangers a minor;
• 🌷infringes intellectual property or other rights, or impersonates someone;
• 🌷contains malware, or attempts to probe, scrape, overload, or break the Service or its security; or
• 🌷sends unsolicited bulk messages or uses recipient contact details for anything other than the personal gift you created.

We may remove content and suspend access for violations, and may report unlawful content to authorities.

Gift links & delivery

• 🌷Each gift has a private link (`/g/<id>`). Anyone with the link can open it — share it only with the recipient. See the Privacy Policy.
• 🌷Delivery options include sharing the link yourself, having us email it, scheduling an email for later, or preparing a text you send from your own device. Email and scheduled delivery depend on third-party email infrastructure; we can't guarantee exact delivery timing or that a recipient's provider won't filter the message.
• 🌷We're not responsible for a recipient not receiving or opening a gift due to incorrect details you provided, spam filtering, or a link shared beyond the recipient.

Our intellectual property

The Bailey's Tulips name, logo, site design, puzzle engines, and original content are owned by us or our licensors and are protected by intellectual-property laws. We grant you a personal, non-exclusive, non-transferable license to use the Service for its intended purpose. You may not copy, resell, or create derivative works from the Service except as these Terms allow.

Our puzzle games are general puzzle formats (word-guessing, grouping, word-search, number, and crossword games) implemented by us. Game names and styling may change. Names of third-party products mentioned anywhere on the Service belong to their respective owners and don't imply any affiliation or endorsement.

Third-party services

The Service relies on third parties (including Supabase, Stripe, Resend, our hosting provider, and — when enabled — Anthropic and an analytics provider). Your use of those features may also be subject to their terms, and we're not responsible for their acts or omissions. See the Privacy Policy for what each one does.

Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We don't warrant that the Service will be uninterrupted, error-free, or that gifts will always be delivered on time. Some jurisdictions don't allow certain disclaimers, so parts of this section may not apply to you.

Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, BAILEY'S TULIPS AND ITS OPERATORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR USD $50. Some jurisdictions don't allow these limits, so they may not fully apply to you, and nothing here limits liability that can't be limited by law.

Indemnification

You agree to indemnify and hold harmless Bailey's Tulips and its operators from claims, damages, and expenses (including reasonable legal fees) arising out of Your Content, your misuse of the Service, your violation of these Terms, or your violation of someone else's rights — including a recipient's claim that you shared their information without authority.

Termination

You can stop using the Service anytime and ask us to delete your account or gifts. We may suspend or terminate access if you violate these Terms or to protect the Service or other users. Sections that by their nature should survive (such as content licenses already granted, disclaimers, liability limits, and indemnities) survive termination.

Changes to these Terms

We may update these Terms from time to time. We'll update the "Last updated" date and, for material changes, give more prominent notice. Continuing to use the Service after changes take effect means you accept the new Terms.

Governing law & disputes

These Terms are governed by the laws of [GOVERNING-LAW STATE/COUNTRY], without regard to conflict-of-laws rules. The courts located there will have jurisdiction over disputes, unless mandatory consumer-protection law in your country of residence provides otherwise.
